Week 4: The Constitution

How would you summarize the Constitution in modern language? Do you believe that it was meant to be “iron-clad”? Should we be able to change parts of the Constitution as time goes on?

It is the fundamental principles of national governance and the basic principles the people should be conform with, in order to live in a certain nation. In layman's terms, it is the most basic law and supreme law that is positioned in above all sorts of rules, orders, and norms. Probably in every country, constitution is established simultaneously with the creation of governments. Every region had different conditions and issues in living, so every constitution was focused on each country's livelihood or conflict resolution skills that they desired. But as the time goes by, after the Earth had become a global village, as the environment changes, so many knew conditions were needed. So probably Constitutional amendments will emerge constantly.

The times have changed a lot. Many countries that have relied on religion in the past are now out of religion. Social lifestyles and people's perceptions have also changed. However, if people's lives have changed and the Constitution at that time is still suspended, this can not be the right standard. The constitution was mostly accompanied by the establishment of the government. For example, in the Korean Constitution, there is an item that aims for unification. However, if Korea becomes unified, such items should disappear. This sentence is no longer meaningful when it is already unified. Therefore, we must continuously revise the Constitution according to each situation and culture at that time. That is why the Constitution of Korea now requires eight revisions.

He explains that because each region has different conditions in life, each country will have different conflict resolution methods. I agree with this opinion. But we are not only a solution to the conflict, but also a very minor part of our lives. Therefore, he should mention this part.

As she said, law can be mutable. It should follow the current time period. We can't always bring antiquity with us. Sometime law should also adapt to the phases of time. However, it shouldn't be change for an individual or a certain group. There are few examples of it in Korean history. When military force had taken over the government, they made an amendment by their own just for their own sake.

The constitution is a written law that has the most important laws that all states must follow. The constitution contains many rights of citizens in United States and they are made to be unchangeable. However, as the time pass, some of the laws in the constitution are not appropriate in nowadays society. For example, the three-fifths compromise is one of constitutional law that should be removed. The three-fifths compromise is slaves considered an only three-fifths person as a citizen that is not appropriate in nowadays. Constitutional laws are one of the laws that should not be changed but little parts of it do not suit for modern day society or useless.

Constitution is a supreme law which is fundamental of all laws and it guarantees basic human rights such as freedom, equal treatment for people, seek for happiness , etc. As we are living in a fast-changing world, the constitution should match that rate of change. Laws and constitutions are made in the past might not always fit in nowadays society. Constitution are the most supreme law of all laws. So it must be strict and logical however it must be flexible too. If the amendment are appropriate to era and approved by the people it should be revocable or changeable.
